Under current law, a remote contract involving a financial service, such as a consumer credit, is treated in the same way as a traditional in-branch credit contract.

Whether you conclude your contract by phone, via the internet or by another digital channel, the lender must fully respect their obligations in terms of investigation, information and advice.

What the Lender Must Tell You Before You Sign

Before you conclude any remote credit contract, the lender has a strict duty to provide you, in due time, with clear and complete information. This must happen before you are bound by the contract, and must include at least four key elements: the identity of the service provider, the main characteristics of the proposed credit, the exact content of the remote contract, and the possible means of redress in case of dispute.

This information must be communicated in a way that fits the remote communication channel used, for example by email or via a secure online space. If, for technical reasons, it is impossible to provide all information before the conclusion of the contract, the law allows it to be sent immediately after the contract is concluded, on a durable medium that you can store and consult.

When the credit contract is concluded via a voice communication system (such as a phone call), a simplified information regime may apply. However, this regime is only valid if you give your explicit consent. You always have the right to request additional information in writing before confirming your agreement.
